WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-257 <br /> <br />RESOLUTION APPROVING THE APPEAL OF RALPH AND PEARL <br />GOOLD OF A DECISION OF THE BOARD OF ADJUSTMENT AND <br />ALLOWING CONSTRUCTION OF AN ACCESSORY BUILDING AT <br />3651 ZWISSIG COURT <br /> <br />at its meeting of June 8, 1983, the Board of <br />Adjustment denied the application of Ralph and <br />Pearl Goold for a variance to allow the construction <br />of an accessory structure which would encroach <br />into the required side yard of the property located <br />at 3651 Zwissig Court; and <br /> <br />within the time specified by the Ordinance Code <br />the City of Pleasanton, Mr. and Mrs. Goold sub- <br />mitted an appeal to that decision to the City <br />Clerk of the City of Pleasanton (AP-83-8); and <br /> <br />of <br /> <br />at its meeting of June 28, 1983, the City Council <br />reviewed a report dated June 21, 1983 from the <br />Director of Planning and Community DeveloDment <br />regarding this matter; and <br /> <br />a duly noticed public hearing was held at which <br />time the applicant and any other member of the <br />public was offered an opportunity to present <br />evidence regarding this appeal; and <br /> <br />Councilmembers Wood indicated he had personally <br />inspected the lot in question and that the size of <br />the lot and adaptability to use for parking a <br />motor home under an accessory structure without <br />adversely affecting surrounding properties constituted <br />special circumstances and that this would not <br />constitute a special privilege; and <br /> <br />after a review of the material presented, the City <br />Council makes the following findings: <br /> <br />that because of special circumstances aDplicable <br />to the property, including size, shape, <br />topography, location or surroundings, the <br />strict application of the provisions of this <br />chapter deprives such property of privileges <br />enjoyed by other properties in the vicinity <br />and under identical zoning classification; <br /> <br />that the granting of the variance will not <br />constitute a grant of special privilege <br />inconsistent with the limitation on other <br />properties classified in the same zoning <br />district; and <br /> <br /> <br />
