AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into on the 24th day <br /> <br />of May, 1983 by and between VALLEY PLAZA ASSOCIATES II, of <br />525 University Avenue, Suite 22, Palo Alto, California 94301 <br />(hereinafter referred to as "Valley") and the CITY OF PLEASANTON, <br />a municipal corporation, of 200 Bernal Avenue, Pleasanton, <br />California 94566 (hereinafter referred to as "City"). <br /> <br /> RECITALS <br /> <br /> A. Valley is the ~ptionee of real property in the City <br /> <br />of Pleasanton shown in Exhibit "A" attached to the Agreement <br /> <br />and made a part hereof by <br />generally of 8.8 acres at <br />Site"). <br /> <br />this reference, which consists <br /> <br />4323 and 4365 Valley Avenue ("Project <br /> <br /> B. LEONTINE HALVERSON, RONALD HALVERSON and DARYL A. <br />HALVERSON are the fee simple owners and optionors of lands <br />including the Project Site. The Halvorsens agree and consent <br />to all the terms and conditions of this Agreement. <br /> <br /> C. Valley has received approval for a planned unit <br />development by Ordinance No. 1078 (PUD-83-1) to be constructed <br />on the Project Site. <br /> <br /> D. Condition No. 2 of PUD-83-1 provides that the PUD <br />approval is conditioned upon the provision of permanent <br />vehicular access to Santa Rita Road substantially as shown <br />on the development plan, which plan shows access from an <br />undeveloped strip of land between the E1 Rancho Motel and <br />the Mission Plaza Shopping Center. <br /> <br /> -I- <br /> <br /> <br />
