SECTION XI <br /> <br /> FOR AND IN CONSIDERATIO~ OF THE COVENANTS AND CONDITIONS TO BE <br /> <br />KEPT AND PERFDRMED BY COUNTY, AS PROVIDED MEREIN, CITY AGREES TO: <br /> <br /> 1. Prepare plans, specifications and cost estimates as required <br /> <br />for construction of the aforesaid roadway improvement. <br /> <br /> 2. Undertake and complete the installation of the traffic signal <br />system at the project intersection, including the portion lying within COUNTY, <br />at no cost to COUNTY. <br /> <br />3. Advertise for' bids and award contract, prepare contract <br />documents, provide construction engineering, and certify the completed work. <br /> <br /> 4. Furnish COUNTY, upon completion and acceptance of all work done <br />under the construction contract, with a reproducible set of "As Built" plans. <br /> <br /> 5. Maintain and operate said traffic signal system upon acceptance <br />of work done under' the construction contract. <br /> <br /> 6. Fully defend, hold ha~less and indemnify COUNTY, its officers, <br />agents, and employees against any and all claims, demands, damages, costs, <br />expenses or liabi3 ity costs arising out of or in connection with the installation, <br />maintenance and operation of the traffic signal and any work performed under <br />this Agreement. <br /> <br /> IN WITNESS WHEREOF, the parties hereto have caused this agreement <br /> <br />to be executed by their respective officers, duly authorized by CITY this <br /> <br /> day of , 1983, and by COUNTY this <br /> day of , 1983. <br /> <br />CITY OF PLEASANTON <br />By: <br /> <br />-2- <br /> <br /> <br />
