AGREEMENT <br /> <br />BETWEEN COUNTY OF ALAMEDA AND C~TY OF PLEASANTON <br /> FOR <br /> <br /> TRAFFIC SIGNAL M~INTENANCE <br /> <br /> AT THE INTERSECTION OF <br /> <br /> BERNAL AVENUE WITH VALLEY AVENUE <br /> <br /> IN PLEASANTON TOWNSHIP <br /> <br /> THIS AGREEMENT, made and entered into by and between the COUNTY <br /> <br />OF ALAMEDA, a political subdivision of the State of California, hereinafter <br />called COUNTY, and the CITY OF PLEASAN~ON, a municipal corporation, hereinafter <br />called CITY, <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, both COUNTY and CITY agree that the installation of a <br />traffic signal system at the intersection of Bernal Avenue with Valley Avenue <br />will be of material benefit to both COUNTY and CITY; and <br /> <br /> WHEREAS, a portion of the proposed traffic signal system is within <br />the unincorporated area of COUNTY and a portion is within CITY; and <br /> <br /> WHEREAS, CITY has indicated its desire to enter ihto an agreement <br />with COUNTY to provide for the maintenance, and to specify the distribution <br />of the costs of such maintenance between the parties of the subject traffic <br />signal system; and <br /> <br /> WHEREAS, such agreement is authorized and provided for by pro- <br />visions of Section 6500 et seq. of the Government Code; <br /> <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> <br />SECTION I <br /> <br /> FOR AND IN CONSIDERATION OF THE COVENANTS AND CONDITIONS TO BE <br />KEPT AND PERFORMED BY CITY, AS PROVIDED HEREIN, COUNTY AGREES TO: <br /> <br /> 1. Pay CITY for' COUHTY's share of operation and maintenance costs <br />as shown in Exhibit "A" and Exhibit "B", attached, within thirty (30) days <br />after' billing by CITY. <br /> <br /> <br />
