Box 520 <br />Pleasanton, CA 94566 <br /> <br /> FIRST ADDENDUM TO LONG-TE~ AGREEMENT <br /> BETWEEN CITY AND PONDEROSA HOMES <br /> <br />(Parcel A of Parcel Map 4014) <br /> <br /> THIS AGREEMENT is made this day of April, 1983, <br /> <br />by a~d between PONDEROSA HOMES, a general partnership ("Ponderosa"), <br />and THE CITY OF PLEASANTON, a municipal corporation ("City"). <br /> <br /> 1. City and Ponderosa have heretofore made and entered <br /> <br />into an agreemenE entitled Long-Term Agreement dated August 24, <br />1982. This Agreement is an addendum to that Long-TermAgreement <br />(attached hereto as Exhibit A). Pursuant to Article I.A of <br />the Long-Term Agreement, City granted Ponderosa growth <br />management approval for the Project as described therein, <br />including, inter alia, 75 units in 1983, 150 units in 1984, <br />and 150 units in 1985. Pursuant to Article II.B of the <br />Long-Term Agreement, building permits may be granted pursuant <br />to the Long-Term Agreement and for utilization within the <br />time limit set forth in the Long-Term Agreement. In the event <br />of the expiration of either the growth management approval <br />or the building permit issued pursuant thereto, the growth <br />management approval so expiring may be reallocated by the <br />City in accordance with its Growth Management Program. <br /> <br /> 2. Ponderosa will acquire and become the fee owner of ' <br /> <br />that certain property described as Parcel A on Parcel Map <br />No. 4014 prepared by Bissell & Karn, Inc., Civil Engineers~ <br />dated April, 1983, a copy of which is attached hereto marked <br />Exhibit "B" and made a ~art hereof by reference.
