5. Notwithstanding any subsequent conveyance of parcel B, <br />Ponderosa will remain liable and responsible for the public <br />needs and obligations expressed in paragraph III.B of the <br />Long-Term Agreement. The growth management fees expressed in <br />paragraph IIIoA of the Long-Term Agreement in connection with <br />the issuance of 25 building permits will be the obligation <br />~f the person who is the owner of Parcel B at the time of <br />the issuance of said buildinB permits. <br /> <br /> 6o This Agreement shall be recorded in the Official Records <br />of Alameda County and shall constitute a covenant running <br />with Parcel B and shall bind the owners thereof, including <br />successors and assigns. <br /> <br /> PONDEROSA HOMES <br /> <br />ATTEST: <br /> <br />James R.
