Box 520 <br />Pleasanton, CA 94566 <br /> SECOND ADDENDUM TO LONG-TERM AGREEMENT <br /> BETWEEN CITY AND PONDEROSA HOMES <br /> <br />(Parcel B of Parcel MaD 4014) <br /> <br /> THIS AGREEMENT is made this day of ADril, 1983, <br /> <br />by and between PONDEROSA HOMES, a general partnership ("Ponderosa"), <br />and THE CITY OF PLEASANTON, a municiDal corporation ("City"). <br /> <br /> 1. City and Ponderosa have heretofore made and entered <br /> <br />into an agreement entitled Lon~-Term Agreement dated August 24, <br />1982. This Agreement is an addendum to that Long-Term Agreement <br />(attached hereto as ExhiBit A). Pursuant to Article I.A of <br />the Long-Term Agreement, City granted Ponderosa growth management <br />approval for the Project as described therein, including, <br />inter alia, 75 units in 1983, 150 units in 1984, and 150 units <br />in 1985. Pursuant to Article II.B of the Lon~-Term Agreement, <br />building permits may be granted pursuant to the Long-TermAgreement <br />within the time limit set forth in the Long-Term Agreement <br />and for utilization within the time limit set forth in the <br />Long-Term Agreement. In the event of the expiration of either <br />the growth management approval or the building permit issued <br />pursuant'thereto, the growth management apDroval so exDiring <br />may be reallocated by the City in accordance with its Growth <br />Management Program. <br /> <br /> 2. Ponderosa will acquire and become the fee owner of <br /> <br />that certain property described as Parcel B on Parcel Map <br />No. 4014 prepared by Bissell & Karn, Inc., Civil Engineers, <br />dated April, 1983, a copy of which is attached hereto market <br />as Exhibit "B" and made a part hereof by reference.
