The ~eveloper and City <br />agree as set forth below. <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, Developer is the optionee of real property in <br /> <br />the City of Pleasanton described in Exhibit A, attached to <br />this agreement and made a part of it by reference, which <br />consists generally of 187 acres located westerly of the <br />intersection of Valley Avenue and Hopyard Roads; and <br /> <br /> WHEREAS, Developer's option agreement provides for a <br /> <br />extend over a period of several <br /> <br />seeking growth management approval <br /> <br />series of options that may <br />years; and <br /> <br /> WHEREAS, Developer is <br /> <br />for the Project under the City's Growth Management Program; <br />and <br /> <br /> WHEREAS, City may enter long-term agreements with <br />p~oject developers meeting the requirements for such agreements <br />pursuant to Ordinance No. 1023 (Growth Management Program) <br />and the implementing procedures contained in Resolution No. <br />82-66; and <br /> <br />-1- <br /> <br /> <br />
