ACQUISITION AGREE~INT <br /> <br /> THIS IS AN AGREEMENT.between the City of Pleasanton, a <br />municipal corporation of the State of'California (hereinafter <br />"the City") and The Prudential Insurance Company of America <br />("Prudential"), a New Jersey corporation, and Callahan-Pentz <br />Properties, Pleasanton, ("CPP"), a California general <br />partnership, (hereinafter "the Owners"). <br /> <br /> The Owners are co-developers of the land generally <br />described as Hacienda Business Park Phase I ("Hacienda") and <br />more particularly described on the parcel map entitled, "Parcel <br />Map 3858, Hacienda Business Park, City of Pleasanton, Alameda <br />County, California," recorded on August 13, 1982 in Book 135 of <br />Maps at pages 49 through 56, inclusive, in the office of the <br />County Recorder of the County of Alameda, State of California. <br />The Owners have respectively constructed within Hacienda certain <br />improvements designed for public use, as more fully described <br />hereafter. The parties intend that these improvements shall be <br />acquired by the City for public use, the cost to be specially <br />assessed against land within Hacienda benefitring from the <br />improvements. The purpose of this agreement is to establish the <br />terms of this acquisition. <br /> <br /> NOW, THEREFORE, THE PARTIE~ AGREE AS FOLLOWS: <br /> <br /> 1. IMPROVEMENTS TO BE ACQUIRED.
