No. 4-0793-CM-1 <br />Document No. Ala-l-4133 <br />Modification No. 1 <br /> <br />MODIFICATION OF AGREEMENT <br /> <br />THIS MODIFICATION OF AGREEMENT, ENTERED INTO ON , <br />1982, is between the STATE OF CALIFORNIA, acting by and through <br />its Department of Transportation, referred to herein as STATE, and <br /> <br /> CITY OF PLEASANTON, <br /> a body politic and a municipal <br /> corporation of the State of <br /> California, referred to herein <br /> ss CITY. <br /> <br />RECITALS <br /> <br /> (1) The parties hereto, on February 10, 1981, entered <br />into an agreement (Document No. Ala-l-4133) which provides for the <br />construction of a'~ehicular/bicycle/pedestrian overcrossing <br />structure (designed to be compatible with any future interchange) <br />and approach roadways on State Highway Route 680 at West <br />Las Positas Boulevard within the city limits of Pleasanton, <br />referred to herein as "PROJECT", and shown on Exhibit A, attached <br />hereto and made a part of this agreement. <br /> <br /> (2) Subsequent to the execution date of said prior <br />agreement, the PROJECT became eligible for Federal-Aid Intersate <br />(R-R-R-R) funds participation. <br /> <br /> (3) It is anticipated that Federal-Aid Interstate <br />(R-R-R-R) funds will be allocated for funding approximately 91.5 <br />percent of the eligible construction costs of PROJECT; and it is <br />anticipated that Federal-Aid Urban (FAU) funds will be allocated <br />for financing approximately 86 percent of the eligible right of <br />way costs of PROJECT. <br /> <br /> -1- <br /> <br /> <br />
