SECOND AMENDMENT TO SEPTEMBER 27, 1983 <br /> REIMBURSEMENT AGREEMENT <br /> <br /> THIS AMENDMENT iS made and entered into this day of <br /> , 1984, by and between VALLEY BUSINESS <br />ASSOCIATES, a California general partnership, and SENTE <br />ASSOCIATES SEVEN, a California general partnership (hereinafter <br />together referred to as "Valley"), and the CITY OF PLEASANTON, a <br />municipal corporation (hereinafter referred to as "city"). <br /> <br />RECITALS <br /> <br /> A. In accordance with the earlier agreement, the City of <br />Pleasanton has been pursuing approval of an at-grade crossing for <br />the Valley Avenue extension at Stanley Boulevard with the Public <br />Utilities Commission. As of October 1984, six days of contested <br />hearings have been completed at the PUC, the hearing has been <br />closed, and the matter is set for briefing in November of 1984. <br />It is apparent that additional funding will be required to bring <br />this PUC application to conclusion. <br /> <br /> NOW, THEREFORE, the parties hereby amend Section 1 of their <br />September 27, 1983 agreement to read as follows: <br /> <br /> "1. Reimbursement. Valley agrees to reimburse the City for <br />a total of Seventy-five Thousand and No/100ths Dollars <br />($75,000.00) in costs to be incurred in order to prepare and <br />process a PUC application seeking approval for the construction <br />of the at-grade crossings on Valley Avenue near Stanley Boulevard <br />and Busch Road." <br /> <br /> Except as specifically amended hereby, all other terms and <br />conditions of the September 27, 1983 agreement are reaffirmed an <br />shall remain in full force and effect. <br /> <br />- 1 - <br /> <br /> <br />
