AGREEMENT FOR LEASE OF PERSONAL PROPERTY <br /> <br /> THIS AGREEMENT is made and entered into this day of <br /> , 1984 by and between the CITY OF PLEASANTON, a <br />municipal corporation and general law city (hereinafter referred <br />to as "City"), and the AMADOR VALLEY JOINT UNION HIGH SCHOOL <br />DISTRICT, a school district formed and existing under and by <br />virtue of the Education Code of the State of California <br />(hereinafter referred to as "District"). <br /> <br />RECITALS <br /> <br /> A. Available Property. As a result of modernization of the <br />City's filing system, the City has available fourteen (14) four <br />drawer file cabinets which are not currently needed by the City, <br />but there is a potential need for future use. <br /> <br /> B. Need. <br />cabinets. <br /> <br />District has expressed a need for ten of the file <br /> <br />AGREEMENT <br /> <br /> NOW, THEREFORE, for and in consideration of the covenants <br />contained herein, the parties hereto agree as follows: <br /> <br /> 1. Lease. The City hereby leases to District the ten file <br />cabinets more particularly described by their City inventory <br />numbers as set forth in Exhibit A. <br /> <br /> 2. Term of Agreement. This agreement shall be for ten (10) <br />years commencing November 15, 1984 and ending on November 15, <br />1994, subject to automatic renewal for a successive ten (10) year <br />period by written notice from District during the six (6) months <br />preceding November 15, 1994 or terminated by the City in <br />accordance with Section 6. City and District agree that after <br />twenty (20) years, the salvage value of said file cabinets is <br />zero and that District may dispose of these file cabinets in <br />whatever manner is then prescribed by law. <br /> <br /> 3. Consideration. The removal and storage of the subject <br />file cabinets during the term of this lease shall be the sole <br />consideration for this lease. <br /> <br /> 4. No WarrantX. City makes no representations or <br />warranties with respect to the file cabinets and District takes <br />said cabinets in an "as is" condition. <br /> <br /> 5. District Responsibility. District may use the file <br />cabinets for any school district purposes, and when normal wear <br />and tear shall cause any of said file cabinets to be no longer <br />usable, District may dispose of said file cabinets after letter <br />notification to the City of Pleasanton. <br /> <br />- 1 - <br /> <br /> <br />
