2. Staff. Project Manager for Consultant shall be Donald J. Rose. Consultant <br />shall not replace Donald J. Rose without the prior approval of the City. <br /> <br /> 3. Sufficiency of Consultant's Work. Consultant agrees that all design and <br />construction documents performed for City shall be proper professional design and <br />construction documents and shall be adequate and sufficient to meet the purposes for <br />which they are performed. <br /> <br /> 4. Ownership of Work. The original drawings, specifications and other data are <br />instruments of service, whether or not the work for which they were made is executed, <br />and are to remain in the possession of the Consultant unless otherwise stipulated. <br />Reproducib]es of all work products as described above in No. 4 of the Consultant's Services <br />will be furnished to the City upon completion of this work. <br /> <br /> 5. Term. It is recognized by both parties hereto that time is of the essence. <br />Consultant shall begin work in November, 1984, and shall be completed in March, 1985. <br /> <br /> 6. Compensation. For the services to be rendered, City shall pay Consultant in <br />accordance with the following schedules. <br /> <br />The design fee for this work will be based on the following schedule: <br /> <br />Construction Cost <br /> <br />Fee <br /> <br /> 0 to $249,000 <br />$250,000 to $299,000 <br />$300,000 to $349,000 <br />$350,000 to $399,000 <br />$400,000 and over <br /> <br />10% <br />9.5% <br />9.0% <br />8.5% <br />8.0% <br /> <br />The surveying construction staking fee will be based on the following schedule: <br /> <br />Construction Cost <br /> <br />Fee <br /> <br /> 0 to $199,000 <br />$200,000 to $249,000 <br />$250,000 to $299,000 <br />$300,000 to $349,000 <br />$349,000 to $399,000 <br />$400,000 and over <br /> <br />2.0% <br />1.9% <br />1.8% <br />1.7% <br />1.6% <br />1.5% <br /> <br />Extra Services <br /> <br />Reproduction costs will be billed at cost plus 10% for handling. <br /> <br />Boundary and topography will be compiled by LandUse from existing plans <br />prepared for the City of Pleasanton by Royston, Hanamoto, Beck & Abey, <br />dated August 1969, and from other record information. LandUse will <br />fieldcheck and update this topography to reflect current conditions. The <br />fee for this work shall not exceed $1,000 and is not included in the <br />percent fee schedule shown above. Boundary information will be compiled <br />fro~m record data and will not be based on an actual field survey. <br /> <br /> <br />
