shall act as, and be, an independent Contractor and <br />not an agent or employee of CITY. <br /> <br />The parties hereto agree to immediately and diligently <br />proceed with their respective duties as set forth <br />herein to the end that the PROJECT will be completed <br />satisfactorily within the shortest reasonable time. <br /> <br />IV. COMPENSATION OF CONSULTANT <br /> <br />A. Basis of Compensation <br /> <br />For and in consideration of the professional services <br />to be provided by CONSULTANT hereunder, CITY agrees <br />to pay CONSULTANT, and CONSULTANT agrees to accept <br />from CITY as full compensation for said services, the <br />following amounts: <br /> <br />For those services described under Section I.A, <br />maximum compensation will be the lump sum of <br />Eleven thousand dollars ($11,000.00) <br /> <br />Compensation for Section I.B. shall be based,on <br /> <br />a percentage of actual construction cost, ranging <br />from 9.5% for $200,000.00of construction cost <br />to 8.0% for $400,000.00 of construction cost, <br />prorated proportionally for costs within the <br />range, plus a fixed sum of $1,600.00 to cover <br />the cost of printing the first thirty (30) sets <br />of Plans and Specifications. <br /> <br />For the services described under Section I.C.1 <br />compensation shall be two percent (2%) of con- <br />struction cost.
