district or districts shall be formed at the time deemed <br />necessary by the City. <br /> <br />II. WATER SERVICE STUDIES AND IMPROVEMENTS <br /> <br /> Developer agrees to pay its proportionate share of the <br /> <br />cost of the water service studies and water service facilities <br />necessary to serve the Property or made necessary due to the <br />cumulative development of the North Pleasanton area. Water <br />service facilities necessary shall be those identified as <br />short- and long-term improvements identified in the above- <br />mentioned water service studies and as deemed necessary by <br />the City Engineer. Developer agrees to participate in the <br />funding of such improvements in whichever manner best achieves <br />timely completion of such improvements concurrent with the <br />development of the Property. The City may require funding <br />by (1) assessment district or districts in which Developer <br />agrees to place the Property; (2) benefit district proceedings; <br />or (3) any other mechanism or combination of mechanisms <br />determined necessary by the City Engineer and/or the City <br />Attorney. <br /> <br /> If Developer installs on the project site a deep well <br />usable for fire service backup in the North Pleasanton area, <br />or over-sized water mains, or any other water service facilities <br />which are both in excess of the capacity required for the <br />Property alone and create a reduction in the cost of the new <br />water service facilities necessary for the North Pleasanton <br />area, the Developer will be credited for such reduction <br />and/or~ if permissible under the financing mechanism selected <br />by the City, directly reimbursed therefor. <br /> <br />-3- <br /> <br /> <br />
