Vice Mayor Cook Kallio said she did not understand it as fully as she would like, appreciates the fact that the applicant has answered many of the questions, but she has the benefit of a staff report and people to whom she can ask questions. She asked the park owner and his representative to work with the City and if this is truly a benefit, this should be communicated to residents. In addition, she also thinks that there are ways to construct a survey and asked for the owner to help the Council and residents understand the issues so that the best decision possible can be made. Mayor Hosterman agreed with Council comments. There seems to be some grey area regarding the definition of a bona fide survey and because of this, she did not believe the process was carried out as well and as fully as it could have been, which is obvious from the results. She thinks it is important to continue the public hearing to another date when the Council is able to receive a truly bona fide survey, and to have staff provide input into the formation of the survey so that it is understandable, that it elicits answers from residents such that the Council can then rely upon that information to make a decision. She pointed out that the application is not being denied, but the Council finds it does not have enough information and the Council does not believe residents had the benefit of having enough information as well. She also wanted the City to do what it can to influence state legislation on the issue. She said perhaps the Sonoma case will be adjudicated in the near future, which would provide additional information with which to make a decision. MOTION: It was M/S by Cook- Kallio/Thorne (1) to continue the item; (2) to direct staff to work with the park owner and his representatives (a) to prepare an informational packet about the conversion that would be provided to the residents, (b) to conduct appropriate outreach to the residents to answer their questions and concerns about the conversion and (c) to prepare a revised survey that the residents would complete and return to the City, after which this item would be returned to the Council for a decision; (3) to support legislation to strengthen local control over mobilehome conversions; and (4) support other public entities' litigation efforts to exercise more and use control over mobilehome conversions.. Consideration of a resolution requesting Pleasanton Water Customers voluntarily reduce their water demand by 20% during the calendar year 2009 Mayor Hosterman noted the City is in its third year of a serious drought, in a regulatory drought, and are also experiencing a crashing of the ecology of the Delta. Operations Services Director, Daniel Smith said staff requests Council approve a resolution for a 20% voluntary water conservation request, said the State's water supply is in drought and the driest it has been in 80 years. In February 2009, the Governor declared a drought state of emergency for California which was a clear message to take action. He said 80% of the City's water supply comes from Zone 7, which affects areas that it provides water to. The main concern is the Department of Water Resources, as in January they indicated the City would receive 20% of its normal allocation, which has been elevated to 30 however, this is far less than what the City would normally City Council Minutes Page 14 of 17 May 5, 2009
