It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Resolution No. 85 -55, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a negative declaration is appropriate in <br />connection with PUD- 84 -21, application of EVH Partnership and the Roman Catholic <br />Bishop of Oakland for PUD zoning and development plan approval of a 262 unit multi- <br />family residential development and related facilities on an approximately 13 acre <br />site located immediately southwest of Bernal Avenue (extension) and the Southern <br />Pacific right -of -way, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Butler, Mohr, and Wood <br />T I NOES: None <br />ABSENT: Manor Mercer (out of Council Chambers momentarily) <br />co It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Q Ordinance No. 1179, approving PUD- 84 -21, application of EVH Partnership and the Roman <br />Catholic Bishop of Oakland for PUD zoning and development plan approval of a 262 unit <br />multi family residential development and related facilities on an approximately 13 acre <br />site located immediately southwest of Bernal Avenue (extension) and the Southern Paci- <br />fic right -of -way, subject to all conditions contained in Planning Commission Resolu- <br />tion No. 2593, and also subject to the following condition: "that in the event the City <br />constructs the 84 ft. wide north /south street to the west of the subject property in <br />advance of the development of this project, the developer shall reimburse the City for <br />the entire cost of the eastern half of that street along the frontage of the proposed <br />prcject.
