13. That the developer submit improvement plans to the <br />City for review and approval by the City Engineer. <br />These improvement plans shall be designed by a <br />registered civil engineer; shall contain plan and <br />profile drawings for all public improvements, and <br />shall meet all City requirements and standards. <br />14. That the developer design and construct storm <br />drainage improvements to collect the existing storm <br />drain channel flow at the south side of Bernal <br />Avenue at the S.P.R.R. right -of -way and convey it <br />in a pipe or other closed conduit to an approved <br />point of discharge. <br />15. That the existing 21 KV overhead power line <br />adjacent to and parallel with the flood control <br />channel be undergrounded to the satisfaction of the <br />City Engineer. <br />16. That the developer enter into an agreement with the <br />City which provides for the following: <br />a. In exchange for the right to construct <br />improvements over and near the sanitary sewer <br />easement which contains the 24 in. diameter <br />interceptor sewer main, the developer will <br />assume the future liability of the cost of <br />replacing or repairing any improvements which <br />may be disrupted, damaged or removed in the <br />event that it becomes necessary to expose, <br />repair or replace the existing sanitary sewer <br />main in order to effect required maintenance. <br />b. In addition, that the developer hold the City <br />harmless in the event of any damage to <br />proposed structures which may be damaged <br />during repair or maintenance of the sewer <br />main. <br />This agreement must be signed by the developer <br />and approved by the City Council prior to the <br />issuance of any building permit in the subject <br />development. <br />17. That the project is subject to all Standard <br />Conditions of Development except conditions 12, 13, <br />29, 31, and 46. <br />18. That no construction shall begin on any part of the <br />development until construction has commenced on the <br />extension of Bernal Avenue eastward to Sunol Blvd. <br />19. That Conditions No. 10 and 11 are subject to any <br />previous agreements between the City and the <br />Diocese of Oakland. <br />
