Box 520 <br />Pleasanton, CA 94566 <br />Attn: City Clerk <br />GRANT OF ACCESS EASEMENT <br />For valuable consideration, the receipt of which is hereby acknowledged, the City <br />of Pleasanton, a municipal corporation ("Grantor"), hereby grants to the Alameda Cormty <br />Flood Control and Water Conservation District - %one 7, ("Grantee"), an access easement <br />over and across the real property described in Exhibit A-I and shown in Exhibit A-2, <br />attached hereto and incorporated herein by reference ("Property"), subject to the <br />following limitations: <br />A. Grantee may construct and maintain a roadway at a width not to exceed fifteen <br />feet on the Property to provide access for Grantee's employees and agents to <br />Grantee's outfall structure on the Bernal Creek at its confluence with the <br />Arroyo de la Laguna. <br />B. Prior to construction or subsequent moditication of such roadway or other <br />improvements on the Property, Grantee shall submit improvement plans to the <br />City of Pleasanton's Community Development Department for review and <br />comment; but normal maintenance of the roadway is not subject to Grantor <br />review and approval; and <br />C. Grantee Curther agrees that if future public improvements by Grantor require <br />the relocation of this access easement, Grantee shall cooperate with Grantor <br />regarding such relocation. <br />Page i of 2 <br />
