(b) ~lodes-Jamieson hereby grants to Lone Star, for its benefit and for the benefit of Lone Star Traffic, an irrevocable non-exclusive license, right- of way, and easement allowing Lone Star Traffic to use the existing Connecting Road. The licenses, rights of way, and easements shall run with the Rhodes-Jamieson Connecting Road property as a whole, and with each parcel or subpart thereof (to the extent such parcel or subpart is subject to the licenses, rights of way, and easements) to the maximum extent allowable under law. In each office where the title to the Rhodes-Jamieson property (or any parcel or subpart thereof subject to the licenses, rights of. way, and easements) is recorded, the licenses,' rights of way and/or easements each may be recorded as encumbrances on the title to the Rhodes-jamieson property (and/or such parcel or subpart thereof which is subject to the licenses, rights of way and easements). Notwithstanding any other provision of this Agreement, Lone Star Traffic shall have no right to use the Connecting Road prior to the expiration of the Injunction Period. Nothing herein contained, how- ever, shall preclude Rhodes-Jamieson from realigning Or d~anging the physical location of the existing Connecting Road at any time, provided, however, that such realign- ment or change shall provide the substantial equivalent of th~ existing Connecting Road in terms of safety and economic impact on the Lone Star Traffic, and further provided that Rhodes-Jamieson shall grant to or obtain -11-
