1 <br /> <br /> 2 <br /> <br /> 3 <br /> <br /> 4 <br /> <br /> 5 <br /> <br /> 6 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br />10 <br /> <br />11 <br /> <br />12 <br /> <br />13 <br /> <br />14 <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br /> I <br /> <br />Traffic proceeding in, or originating from any direc- <br />tion for which an Alternate Route exists. <br /> <br /> (c) In the event that a dispute arises at any <br />time after tile expiration of the Injunction Period <br /> <br />regarding the existence of <br />Lone Star Traffic, or Lone <br />in, or originates from'one <br />right to use the E1 Charro <br /> <br />an Alternate Route for <br /> <br />Star Traffic which proceeds <br />particular direction, the <br />Route shall not be suspended <br /> <br />pending final resolution of the dispute, as set forth <br /> <br />in Paragraph 12 of this Agreement. <br /> 6. <br /> <br /> (a) Kaiser hereby grants to Lone Star,'for its <br />benefit and for the benefit of Lone Star Traffic, an <br />irrevocable non-exclusive license, right of way, and <br />easement allowing Lone Star Traffic to use the Kaiser/ <br />E1 Charro Route, which is owned by Kaiser, and Kaiser <br />also grants to Lone Star, for its benefit, and for the <br />benefit of Lone Star Traffic, an irrevocable non- <br />exclusive license, right of way, and easement allowing <br />Lone Star Traffic to pass over Kaiser property in order <br />to use the Kaiser/E1 Charro Route. The licenses, rights <br />of way, and easements shall run with the Kaiser property <br />as a whole, and with each parcel or subpart thereof (to <br />the extent such parcel or subpart is subject to the <br />licenses, rights of way and easements) to the maximum <br />extent allowable under law. In each office where the <br />title to the Kaiser property (or any parcel or subpart <br />thereof subject to the licenses, rights of way, and <br />easements) is recorded, the licenses, rights of way, <br />and/or easements each may be recorded as encumbrances <br />on the title to the Kaiser property (and/or such parcel <br />or subpart thereof which is subject to the licenses, <br />rights of way, and easements). Notwithstanding any <br />o~hor provisLon o{ this Agreement, i,~,rte Star Traffic <br />shall have no right to use the Kaiser/E1 Charro Route <br />prior to the expiration of the Injunction Period. <br /> <br /> <br />
