RESOLUTION NO. 09-277 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE 2008 WEED ABATEMENT PROGRAM AND AUTHORIZING THE ABATEMENT OF WEEDS, DIRT, RUBBISH OR REFUSE UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE CITY OF PLEASANTON WHEREAS, at its meeting of March 17, 2009, Council adopted Resolution No. 09-272 declaring as a public nuisance all weeds, dirt, rubbish or refuse upon or in front of certain described properties within the City of Pleasanton as more particularly set forth in Exhibit "A", attached hereto; and WHEREAS, Resolution No. 09-272 was adopted pursuant to the provisions of Government Code Sections 39560-39588; and WHEREAS, Resolution No. 09-272 designated April 21, 2009, at the hour of 7:00 p.m., as the date and time and to hear and consider objections to the abatement and removal of weeds, rubbish or refuse upon or in front of certain described properties within the City of Pleasanton; and WHEREAS, the Fire Inspector was charged with the responsibility to perform the duties imposed by Government Code Sections 39560-39588, and did prepare notices to destroy weeds and remove rubbish and refuse; and WHEREAS, the Fire Department, in accordance with Government Code Section 39567.1, did mail written notice of the proposed abatement and removal and the public hearing to all persons owning property described in Exhibit A; and WHEREAS, the City Council did hold a public hearing on April 21, 2009 and no protests were presented; and WHEREAS, abatement of the nuisance may be performed by the City or by a contractor; and WHEREAS, before the weeds are abated by the City or a contractor, any property owner may remove the weeds, rubbish or refuse at the property owner's own expense. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 7. The Fire Inspector is ordered to abate the nuisance declared by Resolution No. 09-272 by causing the weeds, dirt, rubbish and refuse to be removed by the City or a contractor awarded the work by the City for the removal of weeds, rubbish or refuse, and for this purpose, the Fire Inspector (and/or the Fire Inspector's designee) and/or the contractor may enter upon private property to abate the nuisance. Before the weeds are abated by the City or a contractor, any property owner may remove the weeds, rubbish or refuse at the property owner's own expense.
