CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 84-367 <br /> <br />APPROVAL OF MODIFICATION TO ACTEB/ACAP JOINT <br />POWERS AGREEMENT <br /> <br />WHEREAS, <br /> <br />the City Attorney presented his report (SR 84:399) <br />to the City Council regarding the Berkeley lawsuit <br />and the proposed modification to the ACTEB/ACAP <br />Joint Powers Agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the draft amendment to the Joint Powers <br /> Agreement, a copy of which is attached hereto and <br /> incorporated herein by this reference. <br /> <br />Section 2: The City Council hereby rescinds Resolutions No. <br /> and 84-183 approving earlier draft Joint Powers <br /> Agreements for ACTEB/ACAP. <br /> <br />84-123 <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JULY 24, 1984 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Butler, Mohr, Wood and <br /> Mayor Mercer <br />NOES: None ~ N~E , MA~ <br />ABSENT: None <br />ABSTAIN: None <br />ATTEST: <br /> <br /> <br />
