WHEREAS, City policy is adequately preserved through the <br />provisions of an agreement wherein Owner consents to annexation <br />to City at such time as City may require; <br /> <br /> NOW, THEREFORE, City and Owner hereby agree as follows: <br /> <br /> 1. Provision of Water Service. City agrees to allow Owner to <br />connect to City's water system upon execution of this agreement prior <br />to annexation of Owner's land. Connection shall be in accordance with <br />the following: <br /> <br /> (a) Owner agrees to pay the then-existing water <br /> connection fee for connection to the water <br /> system in accordance with applicable City <br /> ordinances. <br /> <br /> (b) Owner agrees to pay all costs associated with <br /> extension of the water system to serve Owner's <br /> land, said system to be designed in accordance <br /> with City standards and subject to City approval. <br /> <br /> (c) Owner agrees to pay an amount computed in <br /> accordance with the applicable City formula for <br /> connection to water facility improvements subject <br /> to a mutual benefit district,.reimbursement <br /> agreement, or any other agreement. <br /> <br /> (d) Owner agrees to pay a monthly water service charge <br /> <br /> as is now or may hereafter be specified by ordinance. <br /> <br /> 2. Agreement to Annex. Owner agrees to consent to annex to the <br />City of Pleasanton all those lands described herein at such time as City <br />may require. Owner and City agree that the provisions of this agreement, <br />state and county laws, and City ordinances and resolutions shall control <br /> <br />-2- <br /> <br /> <br />
