Commission. In response, staff has crafted a new condition of approval that limits the <br />number of instructors on site on weekdays during the hours when the adjoining roofing <br />company operates. This is described further under Option Two below. <br />OPTIONS FOR CONSIDERATION <br />The following are options that the City Council may wish to consider and/or discuss: <br />Option One: <br />The City Council may consider the action by the Planning Commission and its approval <br />with modified conditions to be appropriate. In that case, the City Council would deny <br />the appeal thereby upholding the Planning Commission's original approval shown on <br />Attachment 5. <br />This option would allow Ms. Radayeva to operate her music studio according to the <br />Commission's approval. While the majority of the Planning Commissioners felt that the <br />applicant's proposal would be compatible with the industrial and construction-related <br />uses surrounding the music studio, the Commission imposed specific requirements to <br />ensure child safety and that the rights of Mr. Studzinski to available parking on his <br />property and his future tenants would be provided. <br />Ms. Radayeva is responsible for the conduct of the students and their parents when on <br />site including the parking areas adjoining the studio and the parking areas in front of <br />Mr. Studzinski's building and property. Complaints of noise, loitering, parking, littering, <br />etc., are addressed in the conditions of approval enabling the Planning Division's Code <br />Enforcement section to reply to complaints on a case-by-case basis. <br />Option Two: <br />The City Council may consider the action by the Planning Commission hearing and its <br />approval to be appropriate, but that the number of instructors allowed on-site at the <br />same time during critical periods should be limited. <br />Staff recommends this option to the City Council. The City Council would deny the <br />appeal and modify the Commission's approval to limit the number of instructors to three <br />instructors on-site until 4:30 p.m. and then to allow up to five instructors from 4:30 p.m. <br />to 9:30 p.m. On weekends, the music studio may have up to five instructors until 9:30 <br />p.m. Exhibit A (Attachment 1) includes the recommended change. The Council can <br />include any additional conditions to mitigate its concerns. <br />Ms. Radayeva could still have a total of five instructors, but on weekdays only three <br />instructors could be on site teaching at a single time until 4:30 p.m. <br />Staff discussed this option with Ms. Radayeva and with Mr. Studzinski. Ms. Radayeva <br />concurs with this option. Mr. Studzinski opposes this option. Mr. Studzinski stated <br />that the music studio in any form is an inappropriate use for the Business Park and <br />should move to an alternate site. <br />Page 6 of 8 <br />
