Exhibit A <br />Draft Conditions of Approval <br />Case PCUP-237, Radayeva Music Studio <br />1228 Quarry Lane, Suite A <br />April 21, 2009 <br />1. The location and operation of the proposed use shall conform substantially to <br />Exhibit B (the floor plans and written narrative), dated "Received, January 29, <br />2009," on file with the Planning Division, except as modified by the following <br />conditions of approval. Minor changes to the approved operation and schedule <br />may be approved by the Director of Community Development if found to be in <br />substantial compliance with the proposal. <br />2. The operation of the music studio school shall be limited to: <br />Monday through Sunday, 10:00 a. m. to 9:30 p. m. <br />3. The number of instructors on-site at any one time shall be limited to three <br />instructors until 4:30 p.m., Monday through Friday. Up to five instructors shall be <br />allowed from 4:30 p.m. until 9:30 p.m., Monday through Friday. Up to five <br />instructors shall be allowed until 9:30 p.m., Saturday and Sunday. Any request <br />to add on-site instructors shall be reviewed and approved by the Director of <br />Community Development. <br />4. If additional hours and activities beyond what is stated in the applicant's written <br />narrative, dated "January 29, 2009," on file in the Planning Division, are desired, <br />prior City review and approval is required. Such modifications may be approved <br />by the Director of Community Development if found to be in substantial <br />conformance with this approval. The Director of Community Development may <br />also refer the matter to the Planning Commission if the proposed changes would <br />be significant. <br />5. If operations of this use permit result in conflicts pertaining to parking, interior or <br />exterior noise, traffic/circulation, loitering, or other factors, at the discretion of the <br />Director of Community Development, this conditional use permit may be referred <br />to the Planning Commission for their review at a public hearing. If necessary, the <br />Planning Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke the said conditional use permit approval. Possible <br />mitigation measures may include changing the hours of operation, or other <br />measures deemed necessary. <br />6. No music instruction shall be scheduled in the room that provides access to room <br />number 4, as illustrated on the proposed floor plan. If musical instruction is to <br />take place in that room in the future, the applicant shall request approval from the <br />Director of Community Development to increase the number of instructors and <br />shall show that access to room number 4 can meet the Building Code.
