Attachment I <br />RESOLUTION NO. <br />RESOLUTION APPROVING THE 2009 WEED ABATEMENT PROGRAM AND <br />AUTHORIZING THE ABATEMENT OF WEEDS, DIRT, RUBBISH OR REFUSE <br />UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES WITHIN THE <br />CITY OF PLEASANTON <br />WHEREAS, at its meeting of March 17, 2009, Council adopted Resolution No. <br />09-272 declaring as a public nuisance all weeds, dirt, rubbish or refuse upon or in front <br />of certain described properties within the City of Pleasanton as more particularly set <br />forth in Exhibit "A", attached hereto; and <br />WHEREAS, Resolution No. 09-272 was adopted pursuant to the provisions of <br />Government Code Sections 39560-39588; and <br />WHEREAS, Resolution No. 09-272 designated April 21, 2009, at the hour of 7:00 <br />p.m., as the time, date and place to hear and consider objections to the abatement and <br />removal of weeds, rubbish or refuse upon or in front of certain described properties <br />within the City of Pleasanton; and <br />WHEREAS, the Fire Inspector was charged with the responsibility to perform the <br />duties imposed by Government Code Sections 39560-39588, and did prepare notices to <br />destroy weeds and remove rubbish and refuse; and <br />WHEREAS, the Fire Department, in accordance with Government Code Section <br />39567.1, did mail written notice of the proposed abatement and removal and the public <br />hearing to all persons owning property described in Exhibit A; and <br />WHEREAS, the City Council did hold a public hearing on April 21, 2009 and no <br />protests were presented; and <br />WHEREAS, abatement of the nuisance may be performed by the City or by a <br />contractor; and <br />WHEREAS, before the weeds are abated by the City or a contractor, any <br />property owner may remove the weeds, rubbish or refuse at the property owner's own <br />expense. <br />
