BACKGROUND <br />The weed abatement program, provided in Government Code sections 39560 - 39588, <br />established a mechanism for assuring the removal of weeds, dirt, rubbish and refuse on <br />specified properties that constitutes a public nuisance. All owners of properties included <br />in attachment Exhibit A have been mailed a Notice to abate the nuisance on their parcels <br />and a notice of this protest hearing. The notice included an introductory letter and a list <br />of weed abatement standards. A proof of service was completed by the Fire Department <br />to certify what documents were sent to the property owners. <br />DISCUSSION <br />At this hearing, after considering any objections to the proposed abatement, the City <br />Council should overrule the objections to the proposed abatement and/or amend the list <br />of properties to be abated. The City Council should then adopt the attached resolution, <br />as amended (if at all), that orders a contractor to abate the weeds on the properties <br />attached in Exhibit A. <br />After this hearing, Fire Inspectors will resurvey each parcel listed for compliance. If <br />abatement has not occurred by May 31, 2009, a contractor will abate the weeds. At a <br />public hearing this summer, staff will recommend that the City Council order that the <br />abatement costs be a special assessment and lien imposed on the properties requiring <br />abatement. <br />Submitted by: <br />Fiscal Review: <br />Approved y: <br />Nelson Fialho <br />City Manager <br />William Cody bavid P.
