pay for such. changes or modification if, and to the extent, such <br /> modifications are for the benefit of property previously conveyed to a <br /> third party who shall have agreed, in writing, to assume the obligations <br /> of Developer under this Section II.D. at the time of such conveyance. <br /> <br /> A copy of each such assumption of obligation under this Section D and under <br /> Section E foll<~wing shall be furnished to PGandE by Developer. <br /> <br /> E. Any rearrangelL~nt, relocation, repair of damage, addition <br />to or modifications of the Electric Substructures and Electric and/or Street <br />ti]hting Service [acilities as shown on E~hibit "A" after commencement of <br />constructio;~ which may be required due to acts or omissions of City or <br />~jeve!oper, its age~its, eniployees, contractors or subcontractors shall be <br />paid for on demand and in advance by Developer. <br /> <br /> F. City and Developer or its successors in interest shall, <br />upon the completion of all or any portion of the Electric and Street Lighting] <br />Service Facilities and Electric Substructures installed hereunder and upon <br />demand by PGandE, execute and deliver to PGandE a deed or deeds in the form <br />attached hereto as Exhibit "B" conveying the Electric and Street Lighting <br />Service Facilities and Electric Substructures to PGandE. <br /> <br /> G. Except as provided in Section I.Q. of this agreement, <br />City shall make any payment to PGandE hereunder only fromthe proceeds of <br />ass~ss~ents levied al~d bonds sold in the assessr~lent district proceedings. <br />There shall be n~ liability upon City to make such payments from any other <br />source of funds. PGandE shall not be obligated to proceed hereunder until <br />sufficient funds have b~et~ made available and all payments to PGandE have <br />been made. <br /> <br /> <br />
