breach shall be stayed pending <br />decision following the hearing. <br /> <br /> C. <br /> <br />accordance <br /> <br />responsible <br /> <br />the Director's written <br /> <br /> The City may seize and remove a newsrack in <br /> <br /> with Paragraph 4.A. if the Distributor <br />for such newsrack (i) has neither requested a <br /> <br />hearing before the Director nor remedied the breach within <br />five (5) days following date of notice, or (ii) has failed <br />to remedy the breach within five (5) days after receiving a <br />copy of the Director's written decision that the newsrack <br />was placed or maintained in breach in Paragraph 2 or <br />Paragraph 3 of this Agreement. Such Distributor shall be <br />notified of the seizure. Seized newsracks shall be retained <br /> <br />by Lhe City and may be recovered by the responsible <br />Distributor for a period of at least thirty (30) days <br />following seizure. <br /> <br /> D. Anything above notwithstanding, if a newsrack <br />is installed or maintained in such a place or manner as to <br />pose an immediate and serious danger to pedestrians or <br />vehicles, the City may seize such newsrack without prior <br />notice to the Distributor responsible for such newsrack if <br />it is impractical to remedy the danger by moviag the news- <br />rack to another point on the sidewalk or other public <br />right-of-way. The responsible Distributor shall be notified <br />promptly after such seizure has occurred, anG shall have the <br />rzght to request an inXormal hearing before nhe Director <br />within ten (10) days after receiving such notice to <br /> <br />-8- <br /> <br /> <br />
