EXHIBIT A <br />DRAFT CONDITIONS OF APPROVAL <br />PAP-133 (PMCC-2) /Vesting Tentative Map <br />3263 Vineyard Avenue <br />April 7, 2009 <br />This approval will allow the subdivision of the existing parcel located at 3263 <br />Vineyard Avenue (APN 946-1250-15-2) into 208 air-space condominium units. <br />The condominium plan for this division of air-space shall substantially conform to <br />the tentative "Condominium Plan," Exhibit "B", dated "Received June 5, 2007" on <br />file with the Planning Division, except as rnodified by the following conditions. <br />The final parcel map shall meet all requirements of the Subdivision Map Act. <br />3. All terms and conditions of Use Permit-68-6, to the extent still applicable, shall <br />remain in full force and effect. <br />The final parcel map shall be recorded within two years of the date of this <br />approval or this approval shall lapse. The condominium plan and CC&R's, <br />however, shall not be recorded for at least ten years from the time the final parcel <br />map records and the property owner shall not sell any of the individual units for ai <br />least ten years from the date the final parcel map records. If the final parcel map <br />records within two years of the date of this approval, the property owner shall not <br />be required to comply further with any condominium conversion ordinances then <br />in effect at the time the property owner submits the condominium plan to the City. <br />The 208 condominium units covered by this approval shall be subject to a <br />property owners' association through CC&R's to establish powers and <br />responsibilities for the ownership, use and maintenance of common areas and <br />facilities within the project, including, but not limited to, storm drainage, parking, <br />access, utilities and landscaping. The CC&R's shall be submitted to the City <br />Attorney for review and approval prior to their submittal to the State Department <br />of Real Estate and prior to the recordation of the condominium plan. Any <br />changes to the CC&R's, after the CC&R's have been submitted to the State <br />Department of Real Estate, shall be subject to the review and approval of the <br />City Attorney, which approval shall not be unreasonably withheld. <br />The property owner shall submit the following information to the City Engineer for <br />review and approval: <br />a. Two prints of the final parcel map; <br />b. One copy of a title report; <br />c. One set of the computer closures; and <br />d. One legible copy of the latest recorded deed for the parcel being <br />subdivided; <br />
