SECOND AMENDMENT TO AGREEMENT FOR ENGINEERI~IG SERVICES <br />FOR PROPOSED GRADE SEPARATIONS AND TRACK CONSOLIDATION <br />INVOLVING SOUTHERN PACIFIC TRANSPORTATION COMPANY AND <br />THE WESTERN PACIFIC RAILROAD COMPANY TRACKS BETWEEN <br />NILES AND PLEASANTON IN ALAMEDA COUNTY <br /> <br />PARTIES: <br /> <br /> THIS SECOND AMENDMENT TO AGREEMENT is by and between: <br /> <br /> a. The County of Alameda, a political subdivision of the <br /> <br />State of California, hereinafter referred to as COUNTY; <br /> <br /> b. The City of Pleasanton, a municipal corporation of the <br /> <br />State of California, hereinafter referred to as CITY; <br /> <br />The aforesaid parties hereinafter collectively called AGENCIES; and <br />c. De Leuw, Cather & Company, Consulting Engineers, an Illinois <br />Corporation, with a place of business at 120 Howard Street, San <br />Francisco, California 94105, hereinafter called ENGINEER. <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the parties heretofore have entered into an Agreement <br />dated September 28, 1982 for engineering services in connection with <br />three proposed railroad grade separations involving the Southern <br />Pacific Transportation Company and the Western Pacific Railroad <br /> <br />Company; and <br /> <br /> WHEREAS, <br />AGENCIES, or <br /> <br />because of chanqes and EXTRA WORK authorized by the <br />changed circumstances (as described in the June 28, 1984 <br />letter from Robert Barton to Robert Warnick and Ousama H. Kawar, <br />attached here and incorporated her~in)~ it has been necessary to <br />perform extra work to complete the final design of the project; and <br /> <br />lof2 <br /> <br /> <br />
