incurred by reason of any negligent or willful act or failure <br /> <br />to act of Engineer, its officers, employees or agents, or <br />subcontractors or any of them in connection with this agreement. <br />In addition to any other remedy authorized by law, so much <br />of the money due Engineer under this agreement as shall reasonably <br />be considered necessary by City may be retained until disposition <br />has been made of any claim for damages. <br /> <br />Section H - Consultant's Status <br /> <br />In the performance of the obligations set forth in this agreement, <br />Consultant shall have the status of an independent contractor, and <br />Consultant shall not be considered to be an employee of the City <br />for any purpose.
