3. Time of Construction. The City shall use its best <br />efforts to acquire the remaining rights-of-way necessary to <br />construct the Pimlico Drive realignment/including use of its <br />power of eminent domain, and to install, or have installed, the <br />Improvements in accordance with the Plans and to complete <br />such installation on or before SeDtember 30, 1984. <br /> <br /> 4. Conveyance of Property and Payment Therefor. <br /> <br /> (a) Parcel Map. The City shall process and file a <br /> <br /> parcel map or other acceptable subdivision map (the "Parcel <br /> Map") in the form of the Right-of-Way Map in order to <br /> identify the parcels of land to be conveyed under this <br /> Agreement and to eliminate as separate parcels of land <br /> the lands conveyed to Tracor by the City pursuant to <br /> subsection 4(c). The Parcel MaD shall be filed of record <br /> by the City not later than September 30, 1984. Tracor <br /> shall cooperate with the City in the preparation and <br /> processing of the Parcel Map, provided, however, Tracor <br /> shall not be required to expend any funds or to make any <br /> dedications or improvements as a condition to the approval <br /> and filing of the Parcel Map. <br /> <br /> (b) Tracor Conveyance to the City. Concurrently with <br /> the filing of record of the Parcel Map, and c0nditioned on <br /> conveyance to Tracor by the City of land under Section <br /> 4(c), Tracor shall convey to the City the lands in fee and <br /> easement shown to be conveyed by P~ Associates to the City <br /> of Pleasanton on the Right-of-Way Map. <br /> <br />-4- <br /> <br /> <br />
