D. Under an agreement entitled Interim License for Entry <br />dated May 14, 1984, the City was given a license for entry upon <br />the Property for the purpose of commencihg construction of the <br />improvements. By this agreement, which shall supersede the <br />Interim License for Entry, the City seeks to secur~ a <br />right-of-entry from Tracor to continue construction of <br />improvements and to allow use of the realigned roadway once <br />constructed; however, because the City has no budgeted funds <br />for such acquisition (the acquisition was to be done as part of <br />the NPID), the City wishes to defer payment for the <br />rights-of-way until bonds are sold after the formation of.'the <br />NPID (anticipated to be formed in the Fall of 1984). <br /> <br /> E. Tracor wishes to have the Pimlico realignment <br />completed as quickly as possible and, accordingly, wishes to <br />cooperate with the City in speeding the construction of the <br />realignment. <br /> <br /> F. The City has agreed to allow The Prudential Insurance <br />Company to construct the Pimlico Drive realignment in advance <br />of the formation of the NPID and The Prudential Insurance <br />Company began this work in late Spring, 1984; however, the City <br />must secure the necessary rights-of-way in order to allow the <br />realignment to be constructed in advance of the NPID. <br /> <br />NOW, THEREFORE, the parties hereto agree as follows: <br />1. Grant of Right-of-Entry. Tracor hereby grants <br />permission to the City, its agents, employees, and assigns, to <br />enter upon the Property with such personnel, equipment, <br />machinery, vehicles and material as may be necessary for the <br /> <br />- 2 - <br /> <br /> <br />
