7.10.84 <br />C169-018 <br />AG169c <br /> <br />the City or for which the City has been granted a public <br />service easement or temporary landscape easement, for the <br />purposes of performing any maintenance required under Arti- <br />cles 1, 2 and 3, provided that any and all contractors <br />employed by the Association to perform any maintenance <br />required under Articles 1, 2 and 3 must obtain an encroach- <br />ment permit from the City, which the City shall issue with- <br />out charge to such contractor or to the Association. <br /> <br />harmless <br /> <br /> ARTICLE 6 <br /> INDEMNITY <br /> <br /> The Association shall <br />from any loss, claims, <br /> <br />indemnify and hold the City <br />liability or expense, includ- <br /> <br />ing reasonable attorney's fees and costs, for personal <br />injury or death, or property damage, arising out of or in <br />connection with the activities of the Association or its <br /> <br />employees or agents in the performance of its maintenance <br />obligations, or lack thereof, under this agreement. The <br />City shall indemnify and hold the Association harmless from <br /> <br />any other loss, claims, <br />reasonable attorney's fees <br />death or property damage <br />with public improvements <br /> <br /> liability, or expense, including <br /> and costs, for personal injury or <br /> <br /> arising out of or in connection <br />covered by this agreement. <br /> <br />-6- <br /> <br /> <br />
