The Association is an organization of owners <br />property situated within certain real property <br /> <br />located in the City and commonly known as Valley Business <br />Park, organized pursuant to the Declaration of Covenants, <br />Conditions and Restrictions for Valley Business Part (the <br />"Declaration") recorded as Instrument No. 82-138831 on <br /> <br />September 14, 1982 and amended by Instrument No. 83-070965, <br />recorded April 28, 1983 and Instrument No. 83-161363 <br />recorded August 31, 1983, Official Records of Alameda County: <br /> <br /> B. The Association is authorized by the Declara- <br />tion to maintain certain landscaping, street lighting and <br />appurtenances thereto, and sound walls within and without <br />Valley Business Park as provided in the Declaration; <br /> <br /> C.
