In order for us to schedule this work properly we will require a minimum of 2~ hours notice for these services. Because of our limited involvement in the inspection of the structure, we must ask the City of limit our liability to the City and to all contractors and subcontractors on the project~ due to professional negligent acts, errors or omissions by us, to our fee. We also request the following conditions. We cannot guarantee the completion or quality of performance of contracts by the c~ns~r!.;c~ion contractor or contractors, or other third parties, nor are we responsible for their acts or omissions. City agrees that we will not ~erform continuous on-site construc- tion review 'for this pro3est. that such services will be performed by others, and Chat ~me C~ty ~iil defend, indemnify, and hold us harmless from any and all liability arising from or resulting from the performance of construction review by other persons. The City agrees that in accordance with generally accepted con- struction practices, tile construction contractor will be required to assume sole and cemplete resmonsibility for job site conditions during the course of construction of the project, including safety of all persons and property; 'that this requirement shall be made to apply continuously and not be limited to normal working hours; and the City further agrees to defend, indemnify and hold us harm- less from any and all liability, real or alleged, in connection with the performance of work on this project, excepting liability arising from our sole negligence.
