amendment to the 1978 Agreement by each of the major department <br />store parties identified in Section V-G of the 1978 Agreement. In <br />the event that Properties is unable to obtain the joinder of one <br />or more of such parties to the subject amendment, Properties (and <br />any department store owner(s) whose joinder is obtained) shall <br />enter into the subject amendment in respect of that portion of the <br />Shopping Center owned by Proeprties (and such department store <br />o~ner(s)), with the result that the City's obligations under the <br />1978 Agreement as originally executed shall continue to apply to <br />the parcels of the non-joining department store owner(s). <br /> <br /> 2. Prior Assignments From Original Capacity. <br /> <br /> (a) Stoneridge Peripheral, a California joint venture <br /> <br />and affiliate of Properties ("Stoneridge Peripheral"), has <br />~reviously sold or leased to various developers and/or users <br />parcels within the area herein referred to as the Peripheral Land <br />and, in connection with such sales and leases, has allocated a <br />specific number of gallons per day of sewer discharge capacity <br />from the Original Capacity. Attached hereto as Exhibit B-1 is a <br />schedule setting forth the particular parcels witKin the Peripheral <br />Land which have been sold or leased and the corresponding number <br />of gallons of discharge capacity allocated from the Original <br />Capacity in respect of each such parcel. The only ~ortion of the <br />Peripheral Land presently still unsold or unleased by Stoneridge <br />Peripheral is Parcel 2 as shown on Parcel Map 3551, filed of <br />record on August 27, 1981 in the Official Records of Alameda <br /> <br />County (the "Remaining Parcel"). It is ~resently contemplated <br />that the Remaining Parcel will be sold for commercial development, <br />subject to such murchaser obtaining necessary City approvals <br />therefor. <br /> <br /> <br />
