• The facility would have to obtain a childcare license from the DSS. The <br />proposed facility would need to meet all the requirements of the State for <br />childcare centers including requirements for outdoor play areas. <br />This option would allow the operator to reapply for a use permit for a childcare facility at <br />this or another location. <br />ENVIRONMENTAL ASSESSMENT <br />Projects of this nature are categorically exempt from the requirements of the California <br />Environmental Quality Act (CEQA) Section 15301, Class 1. Therefore, no <br />environmental document accompanies this report. <br />CONCLUSION <br />Staff believes that the conditions of approval required by the Planning Commission <br />relating to requirements for CPR and First Aid training, and background checks for staff, <br />and the requirement to provide some form of outdoor activity for students mitigate the <br />concerns that would be addressed through the State childcare licensing process. Staff <br />continues to support the approval by the Planning Commission as described in Option <br />No. 1. Staff recommends that the City Council deny the appeal thereby upholding the <br />Planning Commissions decision to approve the Conditional Use Permit.
