AGREEMENT <br /> <br /> THIS AGREEMENT is entered into this day of , <br /> <br />1984, by and between the CITY OF PLEASANTON, a municipal <br />corporation (the "City"), and PLEASANTON GARBAGE SERVICE, <br />INC., a California corporation (the "Contractor"). <br /> <br /> RECITALS, <br /> <br /> A. The Contractor collects and dismoses of refuse within <br />the City of Pleasanton as the City's franchisee. <br /> <br /> B. Pursuant to the franchise agreement between the City <br />and the Contractor, the Contractor currently disposes, free of <br />charge, refuse emanating from City parks and downtown streets <br />which is collected by employees of the City and transported to <br />the Contractor's transfer station. <br /> <br /> C. The City wishes to cease collecting and transporting <br />such refuse and wishes to contract with Contractor for this <br />service, and Contractor wishes to undertake said collection and <br />transportation. <br /> <br /> NOW, THEREFORE, in consideration of the foregoing and the <br />mutual covenants set forth herein, the parties hereby agree as <br />follows: <br /> <br /> 1. Collection of Refuse from Street and Park Trash Cans <br /> <br /> Contractor agrees to collect, transport, and dispose of <br />the refuse from trash cans located in City parks and on City <br />streets. <br /> <br /> ao The trash cans to be emptied initially shall be <br />those listed in the attached Exhibit "A", attached hereto and <br /> <br />· -1- <br /> <br /> <br />
