It is the understanding of the parties <br /> <br />that the Southern Pacific Railroad has agreed to abandon this <br />portion of its right-of-way in conjunction with the track consoli- <br />dation project which gave rise to the Bernal Avenue grade separation. <br />This ur~derstanding is based upon an Agreement for Maintenance :~,~d <br />Const:r~c!'ion c,f Grade Separations, Alterat'ion of G~ade Crossi:'~}.'~. <br />Rei. c.,cat ions of Rail road Faci 1~ t~ es, and Reiated Conveyances o ~ <br />Property an~l,'c~ [int:erests There~n l']ffles-Pleasanton Tr:~ck Cons,.-.~] '1- <br />dation Project:, :~ contract enterad into on March 23, 1982 between <br />tha Southern Pacific Transportation Company, tha Western Pacific <br />Railroad Company, the City of Plaasanton, and the County of <br />Alameda ("Track Consolidatiorx Contract"). The Track Consolidation <br />Contract is a matter of public record on file with the City of <br />Pleasanton, and a copy has been provided to San Francisco. <br />Specifically, Section 5 at page 4 of the Track. Consolidation <br />Contract calls for Southern Pacific to abandon its existing track <br />faci!ities within the Sunol Access. Moreover, the Interstate <br />Commerce Cormnission has already approved this abandonment pursuant <br />to Notice of Exemption, September 13, 1982, ICC Finance Docket <br />No. 30023 attached hereto as Exhibit G. <br /> <br /> ii. It is also understood that a Southern <br />Pacific petroleum products pipeline and associated right-of-wav <br />will probably be retained by Southern Pacific in the former <br />railroad right-of-way. <br /> <br />iii.
