PREANNEXATION AND PROVISION OF WATER AND <br />SANITARY SEWER FACILITY AND SERVICE AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this day of <br /> <br /> , 1984 by and between the City of Pleasanton, <br /> <br />a municipal corporation (hereinafter referred to as "City") and <br /> <br />Guy DeGarmo and Virginia DeGarmo (hereinafter referred to as "Owner"), <br />based on the followinq understandings: <br /> <br /> W I T N E S S E T H: <br /> <br />WHEREAS, Owner wishes to connect to the City water and sewer <br />system in order to eliminate reliance on well water and septic tank; <br /> <br /> WHEREAS, City policy requires annexation prior to extension of <br />such services as water and sewer facilities; <br /> <br /> WHEREAS, City, in accordance with State and LAFCO policies and <br />regulations regarding annexation, either cannot or is unwilling to <br />annex small portions of neighboring areas in piecemeal fashion, but <br />may wish to annex such properties either alone or in conjunction with <br />a larger area at some future time; <br /> <br /> WHEREAS, the public health, safety, and welfare of the City's <br />residents as well as those in the neighborinq community are best <br />served by elimination of inadequate well water and sewage treatment <br />system and connection to City water and sewer facilities; and <br /> <br /> WHEREAS, City policy is adequately preserved through the <br />provisions of an agreement wherein Owner consents to annexation <br />to City at such time as City may require; <br /> <br /> NOW, THEREFORE, City and Owner hereby agree as follows: <br /> <br />1. Provision of Water and Sanitary Service. City agrees to <br />allow Owner to connect to City's Water and sanitary sewer system upon <br /> <br /> <br />
