EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PAP-127/PDR-715, Steve Jeffrey <br />927 Montevino Drive <br />December 2, 2008 <br />1. All Conditions of Approval of Tract 5835 shall remain in full force and effect <br />except as modified by the conditions below. <br />2. The applicant shall submit to the Planning Division a detailed landscape plan <br />including the size, location, and species of all the landscape materials reflecting <br />the conceptual plan shown on Exhibit A. The plan shall be drawn to scale by a <br />licensed landscape contractor and shall be designed to replicate the solid <br />landscape screening that previously existed on the site. The applicant shall <br />provide a copy of the landscape plan to the residents at 3105 and 3110 Catawba <br />Court for their review prior to submitting the landscape plan to the Planning <br />Division. Once the Planning Division has approved the landscaping plan, the <br />applicant shall install the landscaping within ninety (90) days of the approval date. <br />Once the landscaping is installed, City staff shall monitor it at regular intervals to <br />ensure that its growth within three years of its installation provides the previous <br />landscape screen. <br />3. The applicant shall not construct or install aboveground permanent structures <br />such as play structures, sports courts, gazebos, decks, etc. Within the rear <br />35 feet of the back yard measured from the rear property line. The applicant shall <br />enter into an agreement with the City, to be recorded, that embodies this <br />restriction. <br />4. To provide screening for privacy and noise abatement, the applicant shall <br />construct, within 90 days of the approval date of the landscaping plan, afour-foot <br />high berm throughout the landscape area between the retaining wall and the <br />house. <br />5. Within 90 days of the approval date of the landscaping plan, the applicant shall <br />landscape with vegetation, as approved by the Planning Division, the existing <br />retaining wall to soften its appearance. <br />6. There shall be no lighting placed on or around the pool that would be directed <br />toward surrounding houses. Any aboveground lights shall be designed in a <br />manner to emit low lighting with downward placement so as not to affect the <br />evening sky or adjacent properties. <br />1 <br />
