AGREEMENT IN CONNECTION WITH THE NILES-PLEASANTON TRACK CONSOLIDATION PROJECT THIS AGREEMENT is made and entered into by and between the CITY OF PLEASANTON, a municipal corporation, hereinafter referred to as CITY, and the COUNTY OF ALAMEDA, a political subdivision of the State of California, hereinafter referred to as COUNTY. WITNESSETH WHEREAS, CITY and COUNTY previously entered into a four-party agreement with the Southern Pacific Transportation Company (SPTC), a corporation, and The Western Pacific Railroad Company (WPRR), a corporation, on March 23, 1982, in connection with the proposed consolidation of the main line tracks of the two aforesaid corporations between the Niles railroad junction and the City of Pleasanton; and WHEREAS, a portion of the proposed track consol idation project is within the unincorporated area of COUNTY and a portion is within CITY; and WHEREAS, it is the mutual desire of CITY and COUNTY to enter into this agreement to set forth their respective engineering, construction, and financial responsibilities in connection with the aforesaid track consolidation project, hereinafter referred to as project; and WHEREAS, such agreement is authorized and provided for by provisions of Section 6500 et seq. of the Government Code of the State of California; NOW, THEREFORE, IT IS AGREED AS FOLLOWS: SECTION I That certain Agreement executed by CITY on September 14, 1982 under Resolution No. 82-361, and by COUNTY on September 28, 1982 under Resolution No. 194665, shall upon execution of this Agreement by both parties hereto become null and void thereafter and the provisions of this Agreement shall supersede and take the place thereof.
