AGREEMENT <br /> <br />IN CONNECTION WITH THE <br />NILES-PLEASANTON TRACK CONSOLIDATION PROJECT <br /> <br /> THIS AGREEMENT is made and entered into by and between the CITY OF <br />PLEASANTON, a municipal corporation, hereinafter referred to as CITY, and the <br />COUNTY OF ALAMEDA, a political subdivision of the State of California, hereinafter <br />referred to as COUNTY. <br /> <br /> WITNESSETH <br /> <br /> WHEREAS, CITY and COUNTY previously entered into a four-party agreement <br />with the Southern Pacific Transportation Company (SPTC), a corporation, and The <br />Western Pacific Railroad Company (WPRR), a corporation, on March 23, 1982, in <br />connection with the proposed consolidation of the main line tracks of the two <br />aforesaid corporations between the Niles railroad junction and the City of <br />Pleasanton; and <br /> <br /> WHEREAS, a portion of the proposed track consol idation project is <br />within the unincorporated area of COUNTY and a portion is within CITY; and <br /> <br /> WHEREAS, it is the mutual desire of CITY and COUNTY to enter into this <br />agreement to set forth their respective engineering, construction, and financial <br />responsibilities in connection with the aforesaid track consolidation project, <br />hereinafter referred to as project; and <br /> <br /> WHEREAS, such agreement is authorized and provided for by provisions <br />of Section 6500 et seq. of the Government Code of the State of California; <br /> <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> <br /> SECTION I <br /> <br /> That certain Agreement executed by CITY on September 14, 1982 under <br />Resolution No. 82-361, and by COUNTY on September 28, 1982 under Resolution No. <br />194665, shall upon execution of this Agreement by both parties hereto become null <br />and void thereafter and the provisions of this Agreement shall supersede and take <br />the place thereof. <br /> <br /> <br />
