approving a proposed development agreement ("Development <br /> Agreement") as substantially set forth in Subparagraph 2.F <br /> of this Agreement: <br /> <br /> (1) The Condemnation Action and its underlying <br /> circumstances have required owners to divest themselves of <br /> the subject property against their wishes and have caused <br /> Owners to be accordingly dislocated from the subject property; <br /> <br /> (2) City is not aware of any inconsistency between <br />the Development Agreement and the City's General Plan, any <br />applicable specific plan, zoning, subdivision or other <br />regulatory ordinances, and there appears to be consistency <br />between the Development Agreement and those laws; <br /> <br /> (3) The Development Agreement appears to be a <br />logical and appropriate planning and zoning use of the land <br />to which it refers. <br /> <br /> F. The parties acknowledge that all claims which have <br />been or could be made by City in the Condemnation action <br />and by Owners in the mandate action are disputed by one <br />another as to both validity and amount. Without admission <br />of either the validity or the amount of any claim the parties <br />desire and intend fully and finally to compromise and settle <br />all claims and finally resolve all their differences in <br />accordance with the provisions of this Agreement. The <br />settlement amount and terms as set forth below have been <br />agreed upon by the parties solely for purposes of settling <br />and resolving their differences, and all parties acknowledge <br /> <br /> <br />
