Owners (the "larger parcel"). <br /> <br /> C. The Condemnation action seeks to condemn the <br /> subject property for the construction, completion and <br /> maintenance of a fully improved public street forty feet <br /> <br /> (40') in width. The location, general route and termini <br /> <br /> of the public street are shown on Exhibit "B" to the <br /> Condemnation action and Exhibit "B" attached hereto and <br /> incorporated by reference. <br /> <br /> D. A separate action entitled "Khushal Dahya Patel, <br /> <br />'et al. v. City of Pleasanton, et al., defendants, and <br /> Valley Plaza Associates II, real party in. interest", <br /> <br /> No. H 96444-3, is now pending in Alameda County Superior <br /> Court (Hayward Branch) (the "mandate action"). In the <br /> mandate action, Owners claim, inter alia, that City's <br /> approval of Valley's application for subdivision Tract <br /> 5164 on certain land in the City of Pleasanton adjacent <br /> and contiguous to the Owners' subject property and larger <br /> parcel was invalid for lack of prior notice to Owners and <br /> an opportunity to be heard by City regarding the proposed <br /> approval of Tract 5164. City and Valley have denied and <br /> continue to deny each and every claim therein. <br /> <br /> E. Subject to the holding of noticed public hearings <br /> pursuant to Government Code section 65867, and based in part <br /> on the following findings, listed below in this Recital E, <br /> City has conceptually approved adoption of an ordinance <br /> <br />-2- <br /> <br /> <br />
