12. At such time as either Disclaimers are filed or <br />partial or full Reconveyances of a Deed of Trust are recorded, <br />Plaintiff CITY OF PLEASANTON shall forthwith obtain an Order of <br />this Court directing the State Treasury Condemnation Fund to pay <br />the sum of $200,000.00 to KHUSHAL DAHYA PATEL, GITA KHUSHAL PATEL <br />and FRED CAPLOE, their attorney; and Defendants KHUSHAL DAHYA <br />PATEL and GITA KHUSHAL PATEL shall immediately execute and file a <br />dismissal of their Cross-Complaint in this action. <br /> <br /> 13. Upon issujnce of its Order directing payment of the <br />~um of $200,000.00 to Defendants KHUSHAL DAHYA PATEL, GITA KHUSHAL <br />PATEl, and FRED CAPLOE, their attorney, and filing of said <br />dismissal of the Cross-Complaint, the Court is authorized and <br />petitioned to enter without further notice a judgment decreeing <br />that the fee simple title in and to the land, improvements, and <br />fixtures on the subject property, more particularly described in <br />Exhibit "A", is taken and condemned as authorized by law; <br />adjudging that the sum of TWO HUNDRED THOUSAND DOLLARS <br />($200,000.00), inclusive of interest, is full, adequate and just <br />compensation for the taking thereof and for the loss of goodwill, <br />if any; and decreeing that the fee simple title to the subject <br />property will forthwith vest in Plaintiff free and discharged of <br />all claims and liens of every kind whatsoever upon recordation of <br />~he Final Judgment herein. <br /> <br /> 14. Said Final Judgment shall also provide that the real <br />property taxes, .including any delinquencies, costs and interest, <br />if any, shall be prorated in accordance with Revenue and Taxation <br /> <br />Code Section 4986 as of the date of the recordation of the Final <br /> <br />Judgment, and such portion of said taxes as is attributable to the <br /> <br />-4- <br /> <br /> <br />
