DISCUSSION <br />In order to facilitate a lot line adjustment, Section 51257 of the Williamson Act permits <br />the public agency in which Williamson Act contracted land lies (here, the City of <br />Pleasanton) simultaneously to rescind an existing Williamson Act contract and to <br />approve a new Williamson Act contract, provided the City Council makes the following <br />findings: <br />1. The new contract would enforceably restrict the adjusted boundaries of the 3.22- <br />Acre Parcel for at least as long as the unexpired term of the rescinded contract, but for <br />not less than 10 years; <br />2. There is no net decrease in the amount of the acreage restricted by the contract; <br />3. At least 90 percent of the land under the former contract remains under the new <br />contract; <br />4. After the lot line adjustment, the parcels of land subject to the contract will be large <br />enough to sustain their agricultural use; <br />5. The lot line adjustment would not compromise the long-term agricultural productivity <br />of the contracted parcel or other agricultural lands subject to a Williamson Act contract; <br />6. The lot line adjustment is not likely to result in the removal of adjacent land from <br />agricultural use; and <br />7. The lot line adjustment does not result in a greater number of developable parcels <br />than existed prior to the adjustment, or an adjusted lot that is inconsistent with the <br />general plan. <br />Here, no net decrease in the acreage under contract will occur as result of this action. <br />The amount of acreage under the new contract will be the same as under the existing <br />contract. Moreover, at least 90% of the land under the existing contract will remain <br />under the new contract. Also, the adjusted 3.22-Acre Lot will be large enough to sustain <br />an agricultural use because the area being added under the new contract is <br />immediately adjacent to the balance of the 3.22-Acre Lot remaining under contract and <br />is used for agricultural purposes. The new contract will enforceably restrict the adjusted <br />boundaries of the 3.22-Acre Lot for the same period of time provided for under the <br />existing contract, 10 years with an annual one-year term extension. <br />Because the lot line adjustment involves the swap of approximately 0.1-acre of land <br />between Lot 30 and the 3.22-Acre Lot and because the land being added to the 3.22- <br />Acre Lot is in agricultural production, the lot line adjustment will not compromise the <br />Page 3 of 4 <br />
