are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The subject building is located in Valley Business Park, which is located in a <br />Planned Unit Development -Industrial (PUD-I) District, and is intended to provide sites <br />for industrial uses, neighborhood and support commercial uses, and office uses. The <br />proposed childcare/martial arts facility would provide child related martial arts services <br />and supervision of children ages 5-12 and martial arts lessons to students 13 and older <br />during the evening. The City has allowed similar uses to be located in industrial and <br />office areas. Staff is not aware that any of these instructional or childcaze-oriented <br />businesses has created any impacts on surrounding businesses. Similaz to other requests, <br />in staffs opinion, the Tri-Valley Martial Arts Academy is compatible with surrounding <br />uses. <br />For the reasons stated above, staff believes that this finding can be made as the <br />application is currently proposed. <br />2. The proposed location of the conditional use and the conditions under which it <br />would be operated or maintained will not be detrimental to the public health, <br />safety, or welfare, or materially injurious to the properties or improvements in <br />the vicinity. <br />The children will be signed in by the applicant and signed out by the parents during the <br />after school programs. During the seasonal camps, the parents will be responsible for <br />escorting children into the facility and signing them in and out upon picking them up. <br />Although the roll up door will be open, the applicant will use a mesh fence to prevent the <br />children from being able to "wander" out of the facility. The applicant has a specialized <br />marital arts liability insurance policy, will install and maintain recorded video <br />surveillance of the interior areas (excluding bathroom azeas), and will install "screamer" <br />alarms on the back door to ensure that the students do not leave the site without the <br />applicant or employees knowledge. For these reasons, staff believes this finding can be <br />made. <br />3. The proposed conditional use will comply with each of the applicable provisions <br />of the Zoning Ordinance. <br />The industrial zoning of the subject site permits the establishment of "recreational" and <br />daycare facilities and similar uses which aze subject to conditional use permit approval. <br />Staff feels that the recommended conditions of approval will help to continue integrating <br />the proposed use without detrimentally affecting the surrounding properties and the City <br />in general. As with any use permit, this use can be suspended or revoked if the <br />conditions aze not met. As conditioned, the facility would comply with all applicable <br />provisions of the Zoning Ordinance.
